Terms and Conditions for Landscaping Hackney

Landscaping work underway in a garden with tools and materialsThese Terms and Conditions set out the basis on which landscaping services are supplied by us in connection with landscaping Hackney and related outdoor works. They apply to all quotations, accepted bookings, and service deliveries unless we expressly agree otherwise in writing. By requesting or confirming a service, you agree to be bound by these terms. Please read them carefully before proceeding with any booking.

In these terms, references to “we”, “us”, and “our” mean the service provider, and references to “you” or “the customer” mean the person, business, or organisation requesting the service. These terms are intended to be practical and fair, setting out the main rules for garden landscaping in Hackney, soft landscaping, hard landscaping, maintenance, planting, clearance, and other outdoor improvement work as described in a quotation or job confirmation.

Team preparing a garden landscaping quotation and site assessmentThese terms are written for a general UK service arrangement and should be read alongside any quotation, scope of work, or written job schedule. If there is any conflict between these terms and a specific written agreement signed by both parties, the signed agreement will take priority to the extent of the conflict. Nothing in these terms affects your statutory rights where those rights cannot lawfully be excluded.

1. Booking Process

A booking is normally made after an enquiry, site discussion, or review of the intended works. We may provide an estimate, a provisional quotation, or a formal written quotation depending on the information available. A quotation is generally based on the details you provide and may be subject to revision if the site conditions, access, materials, or scope differ from what was originally described.

A booking is only confirmed when we have expressly accepted the work, whether by written confirmation, email, digital message, or another clear form of acceptance. Until confirmation is issued, any date or time mentioned is provisional and may change. For larger landscaping Hackney services, we may require a site survey before finalising the booking.

Garden landscaping project with soil, plants, and paving materialsYou are responsible for providing accurate information about the property, access arrangements, underground services, planning restrictions where relevant, pets, parking, and any known hazards. If any material detail changes after booking, you must let us know as soon as possible. Failure to disclose important information may lead to a revised quotation, a delay, or cancellation of the work.

2. Scope of Services and Changes

The scope of work is limited to what is stated in the accepted quotation, job schedule, or written agreement. Any work not expressly included will be treated as additional work and may require a separate quotation or written approval before it begins. This includes extra labour, disposal, materials, or changes made after the original booking.

We may suggest practical modifications where we believe they improve the outcome, safety, or efficiency of the work. However, suggestions do not automatically form part of the contract. If you request a change after the job has started, we may need to adjust the price, schedule, or completion date. For example, landscaping in Hackney projects can change when hidden obstructions, poor ground conditions, or unanticipated site issues are discovered.

Where a task involves plants, turf, timber, paving, soil, or decorative materials, natural variation is to be expected. Colour, size, texture, and seasonal appearance may differ from samples or images. Unless a specific brand or grade is agreed in writing, we will use materials that are suitable and of reasonable quality for the purpose intended.

3. Payments

Prices will be set out in the quotation or confirmed order. Unless stated otherwise, all prices are quoted in pounds sterling and may be exclusive or inclusive of VAT depending on our status and the wording of the quotation. If VAT applies, it will be shown separately or clearly included. Any price estimate is based on the information available at the time and may change if the scope changes.

We may require a deposit before work begins, particularly for larger landscaping projects, bespoke materials, or scheduled labour with advance commitments. The remaining balance is usually due on completion unless an alternative payment structure is stated in writing. For ongoing landscape services in Hackney, payment may be requested in stages or by agreed intervals.

Unless otherwise agreed, invoices must be paid within the period stated on the invoice. Late payment may result in suspension of ongoing works, removal of reserved dates, or recovery action. We reserve the right to charge reasonable costs associated with chasing overdue amounts and any lawful interest or fixed compensation permitted under UK legislation for business-to-business transactions, where applicable.

4. Cancellations, Rescheduling, and Delays

If you wish to cancel or reschedule, you must notify us as soon as possible. The amount of notice required may depend on the type and size of the job. Where materials have been ordered, labour allocated, or specialist equipment arranged, cancellation may result in a charge to cover our reasonable losses. This may include non-returnable items, wasted time, and administrative costs.

We may also need to reschedule due to weather conditions, staff illness, supplier issues, access problems, safety concerns, or force majeure events outside our reasonable control. Outdoor work is often affected by heavy rain, frozen ground, or high winds, and we may decide that it is unsafe or impractical to proceed. In such cases, we will aim to offer a revised date for your garden landscaping services.

If you fail to provide access on the agreed day, or if the site is unsuitable to begin work, we may treat the booking as postponed or cancelled and charge for any wasted attendance or preparation. If we arrive and the work cannot proceed because of a problem within your control, we may still charge a call-out fee or part of the agreed price, depending on the circumstances.

5. Waste, Clearances, and Environmental Compliance

Waste and green debris prepared for lawful disposal after landscapingWhere our services involve removal of garden waste, soil, rubble, timber, green waste, old plants, packaging, or other materials, the handling and disposal of waste will be carried out in accordance with applicable UK waste regulations. Waste must be transferred only to authorised facilities or other lawful routes. We will not knowingly dispose of controlled waste illegally or in a manner that breaches environmental requirements.

Unless the quotation states otherwise, waste disposal charges may be included separately or calculated by volume, weight, or number of loads. The customer must not assume that waste removal is included simply because clearing or dismantling forms part of the work. Any hazardous or regulated waste, including certain treated timber, chemicals, contaminated soil, or items requiring special handling, may need separate arrangements and additional cost.

You must disclose any materials or substances that may be hazardous, contaminated, or subject to special disposal rules before work begins. If unlawful waste, concealed debris, or unexpectedly regulated material is discovered during a landscaping Hackney project, we may pause the work, revise the quotation, or request instructions. We reserve the right to refuse handling or disposal of any item we reasonably consider unsafe, prohibited, or outside the agreed scope.

6. Liability and Customer Responsibilities

We will carry out our services with reasonable care and skill. However, landscaping work carries inherent risks, especially where there is uneven ground, excavation, mechanical equipment, heavy materials, or existing defects in the property. We are not liable for pre-existing conditions, hidden defects, underground services not properly marked, structural weaknesses, or damage caused by information that was incomplete or inaccurate.

You are responsible for protecting valuables, fragile items, and items that may be affected by dust, vibration, noise, or movement of equipment. You should also ensure that pets, children, and unauthorised persons are kept away from the working area. We may refuse to continue if we believe the site is unsafe or if you do not take reasonable steps to manage known risks. In many landscape gardening Hackney projects, safe access is essential for timely completion.

To the fullest extent permitted by law, we do not accept liability for indirect or consequential losses, loss of profit, loss of enjoyment, business interruption, or costs arising from delays caused by factors outside our control. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law.

7. Materials, Plants, and Natural Variation

If we supply plants or natural materials, we will aim to select items that are appropriate for the agreed purpose and season. Plants are living goods and their successful establishment depends on weather, soil conditions, aftercare, watering, sunlight, and other factors beyond our control. We are not responsible for deterioration caused by neglect, drought, frost, pest infestation, or failure to follow aftercare advice where such advice has been given.

Timber, stone, gravel, turf, and similar products may naturally vary in appearance, dimension, and colour. We do not guarantee exact uniformity unless it has been specifically agreed in writing. Where a manufacturer’s guarantee applies, any claim may need to be pursued in accordance with that manufacturer’s process. Our own obligations are limited to the terms expressly stated in this agreement and any mandatory legal rights that apply.

If you choose a particular style, finish, or planting scheme, we will carry out the work with reasonable care, but final performance may be influenced by factors beyond our direct control. For example, a lawn or planting bed may require time to settle and establish after a landscaping service in Hackney, and immediate perfection should not be assumed where natural materials are involved.

8. Access, Permits, and Site Conditions

You must provide safe and reasonable access to the property at the agreed times. This includes access for workers, tools, vehicles, and waste removal where necessary. If parking permits, loading permissions, or access arrangements are required, you are responsible for arranging them unless we have expressly agreed otherwise. Delays caused by poor access or parking restrictions may affect completion times and may result in additional charges.

You must ensure that any areas to be worked on are reasonably clear and available unless clearing has been included in the scope. We may need to move furniture, pots, decorations, or loose items to carry out the work efficiently. If we move items, we will do so with reasonable care, but we are not responsible for fragile items that were unstable, hidden, or already damaged.

Where the site contains underground cables, pipes, irrigation systems, drains, or other concealed services, you must tell us what you know before work starts. We may ask for plans, markings, or further information if excavation or heavy digging is involved. If the necessary information is not provided, we may suspend the work until a safe method can be agreed.

9. Variations, Complaints, and Ending the Agreement

We aim to complete work in line with the accepted quotation and any agreed specification. If you are unhappy with any aspect of the service, you should notify us promptly so the issue can be reviewed. We may inspect the matter, propose rectification where appropriate, or explain why the result differs due to site conditions, natural variation, or the limits of the agreed scope.

Either party may end the agreement if the other party seriously breaches these terms and fails to remedy the breach within a reasonable time after being asked to do so, where remedy is possible. We may also end the agreement immediately if the site is unsafe, access is deliberately obstructed, payment is materially overdue, or you act abusively or unlawfully toward our staff or contractors.

Completed landscaped outdoor area with fresh planting and tidy finishIf the agreement ends before completion, you must pay for the work properly carried out up to the termination date, together with any committed costs that cannot reasonably be recovered. This may include materials purchased for your project, wasted travel, or disposal expenses already incurred. Termination does not affect rights or obligations that are intended to continue after the contract ends, including payment obligations and liability limits.

10. Governing Law

These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. This applies whether the issue concerns booking, payment, service delivery, waste handling, liability, or any related matter. By accepting our services, you agree that any dispute will be handled under this legal framework.

Any dispute that cannot be resolved amicably should be referred to the courts of England and Wales, which shall have exclusive jurisdiction, unless a different forum is required by mandatory law. The aim of this clause is to provide clarity and consistency for both parties when entering a landscaping Hackney service agreement, while keeping the terms straightforward and commercially sensible.

General note: If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. No failure or delay by us in enforcing any provision shall be treated as a waiver of our rights. These terms are intended to form a clear, balanced, and lawful agreement for outdoor service work, including Hackney landscaping services and similar projects.
