Terms and Conditions for Landscaping Hackney

These Terms and Conditions set out the basis on which landscaping services are supplied by us in connection with landscaping Hackney and related outdoor works. They apply to all quotations, accepted bookings, and service deliveries unless we expressly agree otherwise in writing. By requesting or confirming a service, you agree to be bound by these terms. 1. Booking Process

Waste must be transferred only to authorised facilities or other lawful routes. We will not knowingly dispose of controlled waste illegally or in a manner that breaches environmental requirements.

The customer must not assume that waste removal is included simply because clearing or dismantling forms part of the work. 6. Liability and Customer Responsibilities

7. Materials, Plants, and Natural Variation

If we supply plants or natural materials, we will aim to select items that are appropriate for the agreed purpose and season. Plants are living goods and their successful establishment depends on weather, soil conditions, aftercare, watering, sunlight, and other factors beyond our control. We are not responsible for deterioration caused by neglect, drought, frost, pest infestation, or failure to follow aftercare advice where such advice has been given.

Timber, stone, gravel, turf, and similar products may naturally vary in appearance, dimension, and colour. We do not guarantee exact uniformity unless it has been specifically agreed in writing. Where a manufacturer’s guarantee applies, any claim may need to be pursued in accordance with that manufacturer’s process. Our own obligations are limited to the terms expressly stated in this agreement and any mandatory legal rights that apply.

If you choose a particular style, finish, or planting scheme, we will carry out the work with reasonable care, but final performance may be influenced by factors beyond our direct control. 8. Access, Permits, and Site Conditions

9. Variations, Complaints, and Ending the Agreement

We aim to complete work in line with the accepted quotation and any agreed specification. We may inspect the matter, propose rectification where appropriate, or explain why the result differs due to site conditions, natural variation, or the limits of the agreed scope.

Either party may end the agreement if the other party seriously breaches these terms and fails to remedy the breach within a reasonable time after being asked to do so, where remedy is possible. We may also end the agreement immediately if the site is unsafe, access is deliberately obstructed, payment is materially overdue, or you act abusively or unlawfully toward our staff or contractors.

If the agreement ends before completion, you must pay for the work properly carried out up to the termination date, together with any committed costs that cannot reasonably be recovered. This may include materials purchased for your project, wasted travel, or disposal expenses already incurred. Termination does not affect rights or obligations that are intended to continue after the contract ends, including payment obligations and liability limits.

10. Governing Law

These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. This applies whether the issue concerns booking, payment, service delivery, waste handling, liability, or any related matter. By accepting our services, you agree that any dispute will be handled under this legal framework.

Any dispute that cannot be resolved amicably should be referred to the courts of England and Wales, which shall have exclusive jurisdiction, unless a different forum is required by mandatory law. The aim of this clause is to provide clarity and consistency for both parties when entering a landscaping Hackney service agreement, while keeping the terms straightforward and commercially sensible.

General note: If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. No failure or delay by us in enforcing any provision shall be treated as a waiver of our rights.
